1. Who We Are
This Privacy Policy explains how Akii LLC (“Akii,” “we,” “us,” or “our”) collects, uses, discloses, and retains information when you use the Akii mobile application and related services (the “Service”).
2. Scope
This Policy applies to information processed by Akii in connection with the Service. It does not apply to third-party services you use independently (e.g., your device operating system, email provider, mobile carrier, or app stores), which have their own privacy practices.
3. Information We Collect
3.1 Account Information
We collect information you provide to create and manage an account, such as:
- email address
- username
- password (stored in hashed form)
- age eligibility confirmation (as needed to enforce minimum age requirements)
3.2 User Content and Social Features
We collect and process Content you create or submit through the Service, including:
- photos captured in the App
- captions
- comments
- likes and related metadata (e.g., which account liked which photo and when)
- follower/following relationships and blocked-account records
- in-app messages and related metadata
3.3 Location Information (If You Permit It)
If you grant the App permission to access location services, we may collect and store location metadata (including coordinates) associated with photos you capture to enable location-related features. You can revoke permission through your device settings. If permission is not granted, location metadata is not collected through that permission pathway.
3.4 Customer Support Communications
If you contact us, we collect the contents of your communication and related contact details (e.g., your email address) and any information you choose to provide.
3.5 Technical Data; Logs
Akii does not intentionally deploy third-party advertising trackers in the App. However, like most online services, our infrastructure and service providers may process certain technical data (e.g., IP address, request timestamps, and connection metadata) to provide hosting, security, rate limiting, and reliability. We receive or access such information as needed for Service operation and protection.
4. How We Use Information
We use information for the following purposes:
4.1 Provide and Operate the Service
- create and administer accounts
- authenticate users
- store, display, and deliver Content and social features
- maintain follower/following functionality and blocks
- provide user-to-user messaging features
4.2 Safety, Security, and Integrity
- enforce our Terms of Service and community/safety rules
- detect, prevent, investigate, and respond to misuse, fraud, and security incidents
- protect the rights, property, and safety of users, Akii, and the public
4.3 Improve and Debug
- troubleshoot and fix bugs
- maintain and improve performance and reliability
- evaluate Service features and usage in aggregate where feasible
4.4 Legal and Compliance
- comply with applicable law and lawful requests
- maintain records as necessary for legal claims, audits, and compliance obligations
5. Legal Bases (Where Applicable)
Where required by law (including in certain international contexts), Akii processes information based on one or more of the following:
- performance of a contract (providing the Service)
- legitimate interests (security, fraud prevention, service improvement)
- consent (e.g., location permission where enabled)
- compliance with legal obligations
6. How We Disclose Information
We do not sell personal information. We disclose information only as described below:
6.1 Service Providers
We use service providers to support the Service (e.g., hosting, databases, storage, real-time services). Providers may process information on our behalf under contractual confidentiality and security obligations.
6.2 Other Users (Social Sharing)
Other users may be able to see:
- your username
- photos and captions you post
- comments you make
- follower/following relationships as available in the Service
Like attribution may be limited by design (e.g., visible to the content owner), and public like counts may be hidden.
6.3 Legal, Safety, and Rights Protection
We may disclose information if we reasonably believe disclosure is necessary to:
- comply with applicable law, regulation, legal process, or governmental request
- enforce these Terms and protect the integrity of the Service
- protect the rights, property, or safety of users, Akii, or the public
6.4 Business Transfers
If we are involved in a merger, acquisition, restructuring, asset sale, financing, or bankruptcy, information may be transferred as part of that transaction, subject to this Policy and applicable law.
7. Data Retention
We retain information for as long as necessary to provide the Service and for legitimate business and legal purposes, including:
- Account information: retained while your account is active and as needed thereafter for legal, security, and operational purposes.
- User Content and social data: retained until you delete it (where available) or delete your account, subject to technical constraints described below.
- Photo deletion: image files may be deleted from active storage upon deletion, while references may remain in a non-functional or “unavailable” state to preserve message threads, likes, or comments integrity.
- Backups: residual copies may remain in backups for a limited period until cycled out.
8. Your Privacy Rights and Choices
8.1 Account Controls; Deletion
You may request deletion of your account by contacting akii.puertorico@gmail.com. Upon verification, we will take steps to delete your account and associated data from active systems, subject to retention, backups, and legal obligations.
8.2 U.S. State Privacy Rights (Where Applicable)
Depending on your state of residence and applicable law, you may have rights such as:
- access to personal information
- correction of inaccurate personal information
- deletion
- data portability
- opt-out of “sale” or “sharing” of personal information (as defined by certain laws)
- opt-out of targeted advertising and certain profiling
Akii does not sell personal information and does not operate interest-based targeted advertising as a core feature. Where required by law, we will honor applicable requests and provide required notices.
8.3 Puerto Rico Privacy and Security
Puerto Rico law may impose privacy and data security obligations, including breach notification requirements in certain circumstances. If a security incident occurs that triggers legal notice obligations, we will provide notices as required by applicable law.
8.4 How to Exercise Rights
Send requests to akii.puertorico@gmail.com with enough detail to identify your account and the request. We may request additional information to verify identity and protect against unauthorized access.
9. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect information. No system can be guaranteed 100% secure. You use the Service at your own risk.
10. International Data Transfers
We may store and process information in the United States, Puerto Rico, and other locations where we or our service providers operate. Where required by law, we use appropriate safeguards for cross-border transfers.
11. Children
The Service is not directed to children. We require users to be at least 18 years old (or older where required). We do not knowingly collect personal information from children. If we learn we have collected such information, we will take reasonable steps to delete it.
12. Third-Party Links and Services
If the Service includes links to third-party services, those services’ privacy practices govern. This Policy applies only to Akii’s processing.
13. Communications
We may send transactional communications necessary to provide the Service (e.g., account verification, password reset, security notices, policy updates). We do not send third-party marketing emails as a core practice.
14. Changes to This Policy
We may update this Policy from time to time. We will revise the “Last Updated” date and, where required, provide additional notice. Continued use of the Service after the effective date constitutes acceptance.
